Family Visa

Family Migration is the main source of moving to Australia to your close family members. It gives chance to join immediate and extensive family members with their eligible Australian relatives. Sponsorship is must for this visa, through any close family relative who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

There are special categories under this, such as: Partner Visa, Aged Parents Visa, Prospective Marriage Visa and Parents Visa. Now we will discuss this in detail in upcoming deliberations.

Parent Visa

The Parent visa allows parents to migrate to Australia permanently to join their children living in Australia. The Parent visa requires sponsorship from an eligible child in Australia. The Australian government limits the number of available Parent visas available each program year. Therefore, applicants who apply and meet core criteria for this visa are placed in a global queue. Under the Contributory Parent visa program, applicants pay a larger fee with a shorter processing period. The parent visa category includes:

Contributory Parent Visa (subclass)

This visa is designed for parents who are willing to make a higher financial contribution to their migration to Australia. It requires payment of a higher visa application charge compared to other parent visa options. The subclass 173 visa is a temporary visa that allows parents to live in Australia for up to two years before transitioning to the permanent subclass 143 visa.

Parent Visa (subclass)

This is a non-contributory parent visa that does not require a large financial contribution. However, the processing times for this visa can be significantly longer compared to the contributory parent visas. The wait times for this visa can extend to several decades.

Basic Eligibility

In order to apply as a parent, applicants must pass the balance of family test. In addition, all parent migrants must be sponsored by their child who must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen. Applications for the Parent visa must usually be lodged outside Australia. Applicants are also required to satisfy health and character requirements

Aged Parent Visa

The Parent visa allows parents to migrate to Australia permanently to join their children living in Australia. The Parent visa requires sponsorship from an eligible child in Australia. The Australian government limits the number of available Parent visas available each program year. Therefore, applicants who apply and meet hub criteria for this visa are placed in a global line. Under the contributing Parent visa program, applicants pay a larger fee with a shorter processing period.

Here are the key features and requirements of the Aged Parent visa:

Age Requirement:

To be eligible for the Aged Parent visa, the parent must be of age pension age, which is currently set at 61 years or older. Age pension age is gradually increasing in line with the Australian government’s reforms.

Balance of Family Test:

The parent must meet the balance of family test, which means that at least half of their children must be living lawfully and permanently in Australia or be eligible New Zealand citizens.

Assurance of Support:

An Assurance of Support (AoS) is required for the Aged Parent visa. This means that a person or organization must provide a financial undertaking to support the parent and any accompanying family members for a specific period. The AoS ensures that the parent does not have to rely on social welfare benefits upon arrival in Australia.

Sponsorship:

An Australian citizen, permanent resident, or eligible New Zealand citizen child must sponsor the parent for the visa. The sponsor needs to meet certain requirements, including being at least 18 years old and meeting certain residency criteria.

Health and Character Requirements:

The parent and any accompanying family members must meet the health and character requirements set by the Australian government. This includes undergoing medical examinations and providing police clearances.

Visa Application Charge:

The Aged Parent visa has a substantial visa application charge, which is payable at the time of application

NOTE:

The ‘Balance of Family’ test applies to all Parent visa applicants and the applicant must demonstrate that they have at least half of their children living lawfully and permanently in Australia; or more children living lawfully and permanently in Australia than in any one single country overseas.

Partner Visa

An Australian Partner (Spouse) visa allows married and de facto either in opposite or in same-sex partners of Australian citizens, Australian permanent residents or eligible New Zealand citizens to enter and/or remain in Australia. Applicants can apply for a Partner Visa from either inside or outside Australia and are required to meet specific requirements before the visa can be granted. An Australian Spouse visa is initially granted as a temporary visa. After 2 years, the relationship is reassessed and if relationship is deemed to genuine and continuing a permanent visa will be granted.

Generally, to apply for a partner visa, you need to prove that you are in a genuine and ongoing relationship with your partner who is a citizen or permanent resident of the country. This usually involves providing evidence of your relationship, such as marriage or cohabitation certificates, photographs together, joint financial documents, and testimonies from family and friends. Additionally, you may need to meet certain financial requirements, such as demonstrating that your partner can financially support you, or that you have sufficient funds to support yourselves. You will also likely need to undergo medical examinations and provide police clearance certificates to demonstrate that you are of good character and in good health.

Basic Eligibilities

To be eligible or apply for a Partner visa, the applicant must be either married to or in a de facto relationship with another person who is either an Australian citizen; or an Australian permanent resident; or an eligible New Zealand citizen. Each Partner visa applicant must be sponsored by their partner who must be at least 18 years of age and the marriage must be legal under Australian law.

De Facto:

The definition of a de facto partner extends to opposite and same-sex couples. To be eligible to apply for a Spouse visa as a de facto partner, the applicant must show at least 12 months of cohabitation with their Australian partner in the period straight away prior to lodging the visa application. Onshore Spouse visa applicants are required to hold a valid substantive visa and be in Australia at the time that the visa is granted. Offshore Spouse visa applicants are required to be outside of Australia at the time that the visa is granted.All Australian visa applicants are required to satisfy health and character requirements.

Prospective Marriage Visa

A prospective marriage visa, also known as a fiancé visa, is a type of visa that allows individuals who are engaged to an Australian citizen or permanent resident to enter and stay in Australia in order to get married. This visa is specifically designed for couples who intend to marry within the validity period of the visa.

To be eligible for a prospective marriage visa for Australia, you must meet certain requirements, which may include:

Genuine intention to marry:

You must have a genuine intention to marry your fiancé within nine months of entering Australia.

Relationship proof:

You must demonstrate that you have a genuine and ongoing relationship with your fiancé. This typically involves providing evidence of your engagement, such as correspondence, photographs together, and testimonials from family and friends.

Sponsorship:

Your fiancé must be an Australian citizen or permanent resident who is willing to sponsor you and provide financial support during your stay in Australia.

Health and character requirements:

You will need to undergo a medical examination to ensure that you meet the health requirements. You must also meet character requirements, which involve obtaining police clearance certificates from each country you have lived in for a certain period of time.

Age requirement:

You must be at least 18 years old to apply for a prospective marriage visa.
